Capital Corporation Pty Ltd (trading as Capitals.au) is registered with the Australian Securities and Investments Commission (ASIC) and holds FCA registration FRN 982642 for UK operations. By accessing or using our platform, you agree to be bound by these Terms in their entirety.
2. Eligibility
To use Capitals.au services, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into binding contracts
- Not be a resident of a jurisdiction where our services are restricted or prohibited
- Successfully complete our Know Your Customer (KYC) and Anti-Money Laundering (AML) verification process
- Not be a Politically Exposed Person (PEP) without prior written approval
We reserve the right to refuse service to any person at our sole discretion, including where required by applicable law or regulation.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@capitals.au of any unauthorised access to your account. We are not liable for losses arising from your failure to maintain account security.
You must provide accurate, current, and complete information during registration and keep your account information updated. Providing false information constitutes a material breach of these Terms and may result in immediate account termination.
4. Services Provided
Capitals.au provides the following services:
- AI-powered trading signals and market intelligence
- Access to trading platforms including MetaTrader 4, MetaTrader 5, and AI WebTrader
- Forex, cryptocurrency, indices, and commodities trading
- Educational resources and market analysis
- Account management tools and portfolio analytics
Important: Capitals.au does not provide personalised financial advice. All AI signals, market analysis, and educational content are for informational purposes only and do not constitute a recommendation to buy or sell any financial instrument.
5. Fees & Charges
Our fee schedule, including spreads, commissions, overnight financing charges (swap rates), and withdrawal fees, is published on our platform and may be updated from time to time. We will provide at least 14 days' notice of material fee changes. Continued use of our services after the effective date of a fee change constitutes acceptance.
6. Deposits & Withdrawals
All deposits must originate from a bank account or payment method in your own name. We do not accept third-party deposits. Withdrawal requests are processed within 1–5 business days, subject to identity verification and AML checks. We reserve the right to delay or refuse withdrawals where we have reasonable grounds to suspect fraudulent activity or regulatory non-compliance.
7. Risk Warning

8. Intellectual Property
All content on the Capitals.au platform, including but not limited to AI algorithms, trading signals, software, text, graphics, logos, and data, is the exclusive property of Capital Corporation Pty Ltd (trading as Capitals.au) or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Prohibited Conduct
You agree not to:
- Use our platform for any unlawful purpose or in violation of applicable regulations
- Engage in market manipulation, wash trading, or any form of abusive trading
- Attempt to reverse-engineer, decompile, or extract our AI algorithms or proprietary data
- Use automated bots or scripts without our express written permission
- Share your account credentials with third parties
- Engage in money laundering, terrorist financing, or any activity prohibited under the AML/CTF Act 2006
10. Limitation of Liability
To the maximum extent permitted by law, Capital Corporation Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use our services. Our total aggregate liability to you shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
11. Termination
Either party may terminate the account relationship at any time. We may suspend or terminate your account immediately without notice if you breach these Terms, engage in prohibited conduct, or where required by law or regulation. Upon termination, you remain liable for all outstanding obligations.
12. Complaints & Dispute Resolution
If you have a complaint, please contact us at complaints@capitals.au. We will acknowledge your complaint within 5 business days and aim to resolve it within 45 days.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia. For UK clients, applicable FCA regulations and UK law apply concurrently. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia, unless otherwise required by applicable consumer protection law.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 14 days before taking effect. Your continued use of our services constitutes acceptance of the revised Terms.
